Terms

What applies when you leave a device with us, join a plan, or use this website. The important part is about your data.

Last updated October 14, 2026

1.Repairs and walk-in service

These terms are between you and Modern Technologies LLC, and they apply to work we do on your equipment. Leaving a device with us, or asking us to work on your equipment on-site or remotely, means you accept them. If you have plan terms or a signed agreement with us, they control where they say something different. Below, "we" and "us" mean that company. A "repair" or "job" in this part means any work we do on your equipment, at the shop, on-site or remotely, including diagnosis, setup, data transfer and recovery, and virus removal. If something here doesn't sit right with you, ask us before you hand it over and we'll talk it through.

You must be 18 or older to agree to these terms. For a customer under 18, a parent or guardian must approve the job and is the customer for it. You agree we can keep these terms, your ticket and your approvals in electronic form, and that a signature on our tablet, a checkbox, or a reply by text or email counts as your signature. Ask us anytime for a paper copy.

The repair terms in effect when you leave a device, or when we start work on-site or remotely, apply to that job.

1.1You hear the price before we start

Except for the safety steps in 1.3, nothing gets worked on until you've said yes to a price: a quote for the job, or for hourly work, the rate and our estimate of the time. That includes anything we find along the way. If the fault is bigger than the one you described, or the work will run past the estimate, we stop and call you.

Diagnostic work runs $40, and it comes off the bill if you go ahead with the repair. Deeper teardowns are quoted first, before we do them, not after.

Data recovery is no data, no charge. If we can't recover the files you asked for, you owe nothing for that job, the diagnostic fee included. If we refer you to an outside lab, the lab's own prices and terms apply to its work.

After hours (before 8 a.m. or after 4:30 p.m. Monday through Thursday, before 8 a.m. or after 3 p.m. on Friday, on weekends, or on the six holidays we observe), we help when we can, at $150 an hour. We decide whether we can take a request.

1.2Your data, and why the backup is your job

Back up anything you can't afford to lose before you bring your device in. Repair work can cause data loss, and some of it we cannot prevent. A drive that is already failing can die completely the next time it spins up, and that can happen while it sits on our bench doing nothing unusual. We are not responsible for data lost, corrupted or made unrecoverable during a repair, even if caused by our negligence. This does not cover our gross negligence or willful misconduct.

One exception: on a job whose purpose is to move or recover your data, if we lose it through our negligence, we don't charge for that job, or we refund it if you've paid. Apart from gross negligence or willful misconduct, that is the most we owe for the lost data.

That's the disclaimer and we have to say it plainly. Here's what we actually do. We work in a way that gives your data the best chance, we get your OK before we do anything that would wipe a drive, and when a job is specifically about recovering or moving data, that's the job, and we treat it that way. If you're not sure whether something on the machine matters, say so at the counter and we'll plan around it.

If you can't back it up yourself because the machine won't start, tell us. That's a service we offer, and it's cheaper than the alternative.

When we copy or recover data, we keep a working copy until you confirm you have everything, and usually no longer than 30 days after you collect the device, or after it is treated as abandoned under 1.10, then we delete it. We keep it longer only when the law or police require it, or you ask us to in writing. We look at files only as far as the job needs. We may leave out files that carry malware. You confirm you have the right to have us copy and work with the data and software on the device, and that the software is licensed. We won't install or move pirated software. If a device is part of a lawsuit, investigation or legal hold, tell us. We won't do data recovery on it unless everyone's lawyers, or a court, agree in writing.

If your device holds patient health information, tell us before the job. We may decline it, or do it only after we sign a written agreement with you that covers that information.

1.3What we can and can't be responsible for

We stand behind our own workmanship, and the next section says how. Some things sit outside that, and you should know which:

  • Faults that were already there. Devices come in damaged, worn, or previously repaired by somebody else, and we can't be responsible for conditions we didn't cause.
  • Liquid-damaged equipment. Corrosion keeps working after the device is dry. A machine we bring back can fail again later, and we can't warranty that outcome. We'll say so before we start.
  • Devices that were opened, modified, or worked on before they reached us. We'll still take a look, and we'll tell you what we find.
  • Data, in the terms set out above.
  • Software problems that come back because of how a machine is used, or because of software you install after it leaves us.
  • Manufacturer defects and recalls, which are between you and the manufacturer, though we'll help you make the claim.

Some repairs carry a real risk of making a device unusable. Board-level and micro-soldering work on equipment that is already damaged is the clearest example. Where that's the case we tell you before we start, and going ahead means accepting that risk.

A swollen, leaking or punctured battery can catch fire. For safety, and before any quote, we may refuse to power the device on, remove and isolate the battery at no charge, or decline the job. If a battery is unsafe to store or return, we will tell you and send it to a recycler at no charge. Liquid damage keeps spreading after the spill. Cleaning may not save the device, and a device that turned on when you brought it in may not turn on after we open it.

At drop-off we try to note visible damage and known problems on your ticket, and we may photograph the outside of the device. A mark or problem missing from our notes doesn't mean it wasn't there. Please look your device over at pickup and tell us about anything new, so we can look into it.

1.4Our warranty

We warrant our own labor for 30 days from the day you pick the device up, or for work on-site or remotely, the day we finish. If the same fault comes back in that window, bring it in and we'll put it right at no charge for our time.

Parts we supply carry whatever warranty the manufacturer or supplier gives them, and we pass that through to you and handle the claim on your behalf. Ask us what a specific part carries before we order it and we'll tell you.

The warranty covers the repair we performed. It does not cover a new and different fault, physical or liquid damage after the repair, or a machine that has been opened by somebody else in the meantime. It also does not cover a liquid-damaged device or a repair we told you was at your risk under 1.3, unless we write a warranty on your ticket copy or send it to you by text or email.

Any implied warranty on our repair work and the parts we install, including any implied warranty of merchantability or fitness for a particular purpose, lasts only 30 days from the day you pick the device up, or for work on-site or remotely, the day we finish. Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you. We give no other express warranty beyond the one above. Nothing in these terms takes away a right you have under Missouri law that cannot be waived. On a liquid-damaged device or a repair we told you was at your risk under 1.3, unless we write a warranty on your ticket copy or send it to you by text or email, we give no implied warranty on our work, to the extent the law allows. Any maker's warranty on a part we install still passes through to you. For a plan member, this section and the data-job exception in 1.2 apply to repair work on a device you leave with us, even where your plan terms disclaim warranties on the plan's services.

1.5The device has to be yours

By leaving equipment with us you're telling us you own it, or that the owner has authorized you to have it repaired. If that turns out not to be true we may stop work and hold the device until ownership is sorted out.

We do not search your files. If during a job we see material that appears to show the sexual abuse of a child, Missouri law requires us to report it to police, and we will. We will stop work, won't make any further copy of the material or show it to anyone but police, will turn over to police any copy the job already made, and may hold your device for police instead of returning it. If we see something else that appears to show a crime or a threat to someone's safety, we may report it to police, unless your plan terms limit that.

If we have reason to believe a device is lost or stolen, we may keep it, contact police, and release it only as police direct, unless your plan terms limit that. We may ask for photo ID and note it on the ticket.

1.6Passwords and access

Bring the password or passcode. We can't test a repair on something we can't log into, and a machine we can't verify is a machine we can't confidently hand back. Where a repair needs it we may reset software or restore a device to factory condition, but only after you give us your OK, in person or by text or email, because it erases what's on the device.

If your device has Activation Lock, Find My, Google Factory Reset Protection, a work management profile or another owner lock, you must turn it off, give us what we need to work with it, or be here to sign in. We never bypass these locks. We turn one off only with the account owner's sign-in or the written OK of the organization that set it up. Some repairs need Find My turned off. If the lock stays on, we may not be able to test or finish the repair. You pay for any diagnostic work and any other work and parts you approved that we completed. The diagnostic fee comes off the bill if you went ahead with the repair, as 1.1 says. Our labor warranty on a repair we couldn't test, and the 30-day limit on implied warranties in 1.4, start on the day we are able to test it, if you bring it back for testing within 30 days after 1.4's warranty would otherwise start; otherwise both run as 1.4 says. Change any password you give us after the job.

For remote work on a computer that isn't under one of our plans, we connect only after you approve the session on your screen, you can watch and end it at any time, and when the job is done we remove our access. Remote work under a plan follows the plan terms. We may record remote sessions and support calls, for quality, training and our records.

1.7Parts

We use new parts unless we tell you otherwise and you agree. On older equipment the only part available is sometimes used or refurbished, and where that's the case we tell you before we order it and it goes on your invoice that way. Before we install a part, we tell you whether it is new, used or refurbished, and whether it is made by the device maker or by another company, as our supplier describes it. Where we have more than one option, we tell you the price of each.

Federal law says a maker can't void your warranty just because someone else repaired the device, but the maker can refuse to cover damage it says the repair caused, and protection plans like AppleCare+ may exclude devices with outside repairs or non-genuine parts. If your device is under a maker warranty or protection plan, check with them first. Some phones show a message such as "unknown part" when a part hasn't been paired to the phone by the maker. That message alone doesn't mean the part is faulty.

We give you back a storage drive we remove, unless you ask us to dispose of it, or you choose a warranty or exchange that requires us to send it back to the supplier or lab. We tell you before the work starts. We erase a drive we send back when it can be erased; if we can't, we tell you before we send it, and you can keep the drive instead of making the claim. If we dispose of a drive, we erase or physically destroy it first. Other parts we remove are recycled, or returned to the supplier for a warranty or exchange, unless you ask for them back before the work starts. We don't return a battery we judge unsafe to store or return (see 1.3).

Some jobs, like board-level repair, recovery from a failed drive, or maker warranty service, go to an outside lab or the maker. We tell you and get your OK before your device leaves our shop. These terms cover our part of the job. The lab's or maker's own terms and warranty apply to their work, and we pass on any warranty they give.

1.8Payment

Payment is due when you collect the device, or for work on-site or remotely, when we finish. We may keep the device until the bill for the work on it is paid, to the extent Missouri law allows and unless your plan terms say otherwise.

Parts we special-order for you are paid for when we order them, and we tell you the price and expected arrival first. Once ordered, they can't be canceled or refunded, and the part is yours: if you decide not to go ahead, you can take it. We refund in full if the part arrives defective or isn't what we ordered, or if the supplier cancels or can't deliver within 30 days of the date we gave you. We may, but don't have to, ask the supplier to take back a part you no longer want; if they do, we refund what they refund us.

If you have a problem with a charge, contact us first so we can fix it. If you dispute a charge with your card issuer, we may send them your ticket, approvals and photos.

1.9How we'll reach you

We use the phone number and email you give us to talk to you about your repair: quotes, approvals, questions, and telling you when it's ready. That includes text messages if the number you give us can receive them, and your carrier's normal rates apply. Tell us to stop texting and we'll stop, and it won't affect your repair.

These are messages about your own job. We may also email you about our own services and programs; tell us to stop and we will. We don't send marketing texts. After a job we may ask once, by text or email, how it went.

1.10Picking your device up

When a device is ready to collect, repaired or not, we tell you using the contact details you gave us (by text, email or phone call, and not by text if you've told us to stop), and remind you again at 30, 60 and 85 days. If it is still here 90 days after the first notice and you haven't collected it or agreed with us in writing on a later date, it is abandoned: we may recycle it, keep it for parts, or sell it, as Missouri law allows, and put any sale money toward what's owed.

Whatever happens to an unclaimed device, the data on it does not go with it. We erase the storage, or physically destroy it if it can't be erased, before anything is sold, recycled, scrapped, or used for parts. That is not a courtesy, it's the only responsible way to dispose of a machine somebody trusted us with.

We release a device to the person who dropped it off, to someone they name on the ticket, or to the owner once we can confirm ownership; for a business device, to a contact the business has named to us. We may ask for photo ID or your ticket number first, and we may refuse release if we can't confirm who you are.

We'd much rather give you your device back. If you need more time, ask us and we'll agree on a date in writing. The clock is about equipment nobody ever comes back for, not about somebody having a difficult month.

1.11Work we turn down

We can decline a job. Usually that's because the repair isn't economic, the parts don't exist anymore, or the risk of making things worse is higher than the chance of fixing it. We'll tell you which, and we'll tell you honestly if the answer is that you're better off replacing it.

1.12What we're responsible for

To the extent the law allows, our total liability for any claim connected to a repair is limited to what you paid us for that repair, and we are not liable for indirect, incidental, or consequential damages, such as lost data or lost profits. This limit does not apply to our gross negligence or willful misconduct. Nothing here takes away a right Missouri law says you keep.

We aren't responsible for delays caused by things outside our control, like maker backorders, shipping delays, storms, or power or internet outages. We will tell you about a long delay. You can stop the job and collect your device during our open hours, after paying for work and parts already done or ordered, unless your plan terms say otherwise, and subject to the other holds in these terms.

1.13Which law applies

These terms are governed by the laws of the State of Missouri. Any dispute will be brought in the state or federal courts serving Cole County, Missouri.

1.14If we let something slide

If we let something slide once, we can still rely on that term later. A change we make in writing under the next paragraph stays in place for that job. If any part of these terms is found unenforceable, the rest stays in effect.

For a repair job, the agreement is these terms, your ticket, any written estimate, the approvals you give us, and any plan terms or signed agreement you have with us. You can ask for a printed or emailed copy of your ticket at drop-off. A change to these terms for your job counts only if it is in writing to you, on your ticket copy or by text or email from us. Your ticket copy or written estimate, as given to you, controls over these terms for that job, and plan terms or a signed agreement control over both where they say something different.

1.15Questions

Ask us before you leave the device, not after. That's what the counter is for, and our number and hours are on the contact page.

We send notices about your job to the phone number and email on your ticket, by text only if you haven't told us to stop. Keep them current; a notice sent there counts as given. Send notices to us at 300 East High Street, Jefferson City, MO 65101, or by email to support@modern1tech.com.

2.Plans

Each plan has its own terms, which you accept when you sign up. For the plan itself, they control over anything on this page. A device you leave with us for repair, including as a member, also follows Repairs and walk-in service above, except where your plan terms say something different. Read them in full before you join.

3.Using this website

This part applies to this website. Work we do on your equipment is covered by Repairs and walk-in service above. Plans are covered by Plans above and by the terms you accept when you sign up, as Plans above describes.

3.1Using this site

Read it, print it, send it to somebody who needs a computer fixed. What you can't do is break into it, scrape it in a way that degrades it for anyone else, or use it to do something illegal. We may change or take down any part of the site at any time.

3.2Prices and information on this site

The rates published here are what most jobs of that kind run. Except as your plan terms say, they are not a quote and they are not an offer we're bound to. What a specific job costs depends on the device and the fault, and we tell you the number before we start work. If a price here and a price we've quoted you disagree, the quote is the one that counts.

We try to keep everything on this site accurate and current. We don't promise it is free of errors, and, except as your plan terms say, we can change prices, services, and hours without notice.

3.3This site is not advice

Anything here about computers, repairs, security, or backups is general information. It is not a professional recommendation for your particular situation. Call us and we'll give you a real answer about your actual machine.

3.4Our name and our content

The Modern Technologies name, our logo, and the text, photographs, and design of this site belong to us. You may not use our name or logo to suggest we endorse, supply, or are affiliated with something we aren't.

3.5Links to other sites

Where we link somewhere else, we're pointing at something useful. We don't control those sites and we're not responsible for them.

3.6No warranty on the site itself

This website is provided as is. We do not warrant that it will be uninterrupted, error free, or free of harmful components. This paragraph is about the website. It does not limit any warranty we give you on actual repair work, which is set out in Repairs and walk-in service, or any right you have under Missouri law that cannot be waived.

3.7What we're responsible for

To the extent the law allows, we are not liable for indirect, incidental, or consequential damages arising out of your use of this website, and our total liability connected to this website will not exceed one hundred dollars. Again, this is about the website. Our responsibility for work performed on your equipment is addressed in Repairs and walk-in service, and nothing here takes away a right Missouri law says you keep.

3.8Which law applies

These terms are governed by the laws of the State of Missouri, without regard to its conflict of laws rules. Any dispute arising out of this website will be brought in the state or federal courts serving Cole County, Missouri, and both of us agree those courts have jurisdiction. If we let something slide once about this website, we can still rely on that term later. If any provision of this part is found unenforceable, the rest stays in effect.

3.9Changes

We update this part from time to time, and the date at the top changes when we do. Continuing to use the site after a change means the updated version of this part applies. Repair jobs follow the version in effect as Repairs and walk-in service describes.

3.10Questions

Call us, email us, or stop by during business hours. Our number and address are on the contact page.
