Home plan terms
The full terms you accept when you sign up. For your plan, they control over anything else on this site. A device you leave with us for repair also follows the repair terms, except where these terms say something different.
These Terms of Service are between MODERN TECHNOLOGIES LLC ("we", "us"), 300 East High Street, Jefferson City, MO 65101, (573) 635-0201, support@modern1tech.com, and the residential member named on the signup sheet or our online signup page ("you"). These Terms of Service govern your Residential Membership with MODERN TECHNOLOGIES LLC. They start on the date your first payment is processed (the "start date") and continue month to month until they end under section 15. Your signup, on paper or online, records your name, contact details, service address, number of devices managed (your covered computers, see section 7), the plan and the price.
1.Fees and Billing
1.1$40 a month covers up to 3 computers. Each computer after 3 adds $10 a month.
1.2If you add or remove a computer, your next monthly charge changes to match.
1.3Your membership renews automatically every month. Your monthly total is charged on your billing date: the day your first payment is processed, and the same day each month after that, until you cancel. If that day does not exist in a month (the 29th, 30th or 31st in a shorter month), we charge on the last day of that month instead. The standard setup and checkup are part of the first month.
1.4Refunds are covered in sections 15.1, 15.2 and 15.4.
1.5A payment method on file is required for membership. Payments are processed through Stripe, our payment processor. By accepting these terms you authorize us to charge your payment method on file for the monthly total on your billing date each month until you cancel, and for support time and on-site time billed under section 2.4, including time not yet charged when your membership ends. We do not store your full payment details; Stripe does.
1.6Billing is never reduced or paused while a computer is offline. The monthly total is the same whether or not a computer was on or connected during the month.
1.7We may change our prices, including our standard shop rate for remote support, our on-site rate and our after-hours rate, no more than once in any 12 months, with 60 days' written notice. You may cancel before the change takes effect, and the change does not apply to you if you do.
1.8Any sales tax that applies to the membership will be shown before you pay.
2.Included Services
2.1Management software. We install our remote management software (an RMM agent) on the covered computers so we can keep them patched, check their health and see problems.
2.2Antivirus. We turn on and manage the antivirus built into Windows and macOS. There is no separate antivirus product.
2.3Standard setup and a one-time checkup, done after your first payment. We bring each covered computer to our standard setup: we install our management software, remove other security software that conflicts with ours and remote-access tools we did not install, and turn on our required security settings. You keep your own software licenses and subscriptions; we do not cancel them. Removing a program does not cancel or refund its subscription; cancel it with its seller if you no longer want it. Some security programs come with a password vault, VPN or backup that stops working on that computer when the program is removed; tell us before setup if you use one, and save anything you need from it first. We are not responsible for charges from, or data kept in, software we remove under these terms. Other software we do not support is pointed out to you, not removed. We tell you what we found. Anything that needs fixing beyond our standard setup is quoted, and we do it only if you approve the quote.
2.4Support: the first 15 minutes of each support session are free, by phone, remote or in person at our counter. Support works the same way in all three. A support session is a phone call, remote connection or counter visit for the same request. Calls, connections and visits about the same request on the same day count as one session. Time past 15 minutes is billed automatically in quarter-hour increments, rounded up, with no minimum, at our standard shop rate for remote support, listed at modern1tech.com, and added to your next monthly charge. Minimums listed with our public rates do not apply to members. We give you 60 days' written notice before that rate changes, as for any price change under section 1.7. Each billed session is listed on your bill with its date and the time billed; tell us within 60 days if you think one is wrong. We may waive time. After hours means any time outside our support hours: before 8 a.m. or after 4:30 p.m. Monday through Thursday, before 8 a.m. or after 3 p.m. on Friday, on weekends, or on the six holidays we observe (New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day), also posted at modern1tech.com; we change that list only with notice under section 1.7. After-hours service is available to members only. Time you ask us to work after hours, if we can take it, is billed in quarter-hour increments, rounded up, at our after-hours rate in place of our other rates, listed at modern1tech.com ($150 an hour as of this version), and the free 15 minutes still apply to support sessions. Only the time that falls after hours is billed at that rate. Routine maintenance and other work we choose to do after hours is never billed at that rate. On-site time in Jefferson City is billed in quarter-hour increments, rounded up, at our on-site rate, listed at modern1tech.com ($100 an hour as of this version, travel included), with no free time, and added to your next monthly charge. On-site work outside Jefferson City is quoted first. Quoted work, repairs and anything we buy for you are not support time; they are paid as stated on the quote.
2.5Support includes your other household devices. We help with phones, tablets and other devices at your residence that the membership does not manage, as support under section 2.4. Routine maintenance and our standard setup cover only covered computers.
2.6Routine maintenance, done remotely on our schedule, as described in section 6.
2.7Our standard setup stays in place while you are a member. When we remove a remote-access program we did not install, we tell you, and we put it back on request if you confirm it is yours and it does not conflict with our management software. Security software that conflicts with ours is not put back. Tell us about any remote-access, security or work software your employer requires; we leave it in place, and if it conflicts with ours, we tell you and that computer may be left out.
2.8Support is scheduled as promptly as our workload allows; we do not guarantee response times.
3.Malware and Security Incidents
3.1The membership keeps covered computers updated and set up to lower the risk of malware, scams and unauthorized access. It does not prevent them, and it does not include cleaning up after them. If something gets through, contact us. We respond and help remotely as support under section 2.4.
3.2Work beyond remote support, such as reinstalling Windows or macOS, is quoted first. An on-site visit is billed under section 2.4.
3.3A reinstall can erase files. We do not reinstall without your OK in writing (email or text counts). Restoring your data is not included (see section 9), so copy anything you need before you give your OK.
3.4Sections 10 and 11 apply.
4.Services Billed Separately
4.1Work you ask for outside the plan, including the examples listed in section 6.4. Support by phone, remote or at our counter is billed under section 2.4. On-site work is billed under section 2.4, with no free time. Billed time is owed whether or not the problem is fixed.
4.2Repairs and anything found beyond routine maintenance or our standard setup.
4.3Hardware, software and anything else you ask us to buy or install.
4.4Except for support time and on-site time billed under section 2.4, we quote work outside the plan before we start it, and we do not start without your OK. Work you approved and support and on-site time already used stay owed even if you later cancel or dispute a charge.
5.Service Credits
If we give you a service credit, it is good only toward work and services we do for you that are billed separately under these terms. It never applies to the monthly membership charge, or to hardware or software we buy for you. A service credit has no cash value, cannot be transferred to anyone else, and ends when your membership is canceled or otherwise ends. A credit expires on the date stated when we give it or in the rules of the program that earned it. We may offer referral and other promotional programs, with their rules posted at modern1tech.com. We may change or end a program at any time; credit you have already earned is still honored under the rules in place when you earned it, subject to the rest of this section.
6.Routine Maintenance
6.1Routine maintenance is done remotely, on a schedule we set. We do not watch computers around the clock. Routine maintenance runs in the background. Restarts are scheduled outside your active hours when possible; urgent security updates may require a sooner restart.
6.2We maintain only computers that are on and connected. Maintenance missed while a computer is offline runs as soon as practical after it reconnects.
6.3Included (examples): updates, patches, the built-in antivirus, monitoring, health checks, and keeping our standard setup in place, including detecting and removing remote-access tools we did not approve.
6.4Not included (examples): work you ask for, such as fixes, software installs, printers, email, new devices, hardware and data recovery, and help after malware, a scam or unauthorized access. That work is billed under section 4.
7.Covered Computers
Windows and Mac computers at your residence. Phones, tablets and other devices are not covered computers: we do not manage or maintain them, but we are glad to help with them as support under section 2.5. A Windows or Mac computer that no longer receives security updates from Microsoft or Apple stays covered on a best-effort basis: we keep supporting and maintaining it as far as we reasonably can, but we cannot keep it fully secure, and we will recommend upgrading or replacing it.
8.Authorization and Access
8.1You must be 18 or older to become a member.
8.2By signing the signup sheet or accepting these terms you confirm that you own the covered computers or are allowed to authorize this work on them, and you permit us to install our management software, to bring the computers to our standard setup under section 2.3, and to look at the computers' settings, installed software and security status as needed to do the setup, the checkup and the work under these terms. Before we connect to your screen to work on it, we will ask you. If you remove our software, we cannot manage that computer, and it is no longer covered.
9.Backups
We do not back up your data unless you buy backup from us. Membership does not include backups of your files, photos, email or anything else. If you want backups, ask us; it is a separate purchase with its own price. If you have not bought backup from us, you are responsible for keeping your own copies.
10.Disclaimer of Warranties
The service is provided as is, without any implied warranty, including merchantability or fitness for a particular purpose. We do not guarantee results, and we do not promise that a computer will never fail or be infected. Protection software lowers your risk and does not remove it.
11.Limitation of Liability
11.1We are not liable for: (a) problems caused by updates or patches from Microsoft, Apple or other vendors, or by updates or maintenance missed while a computer was offline; (b) viruses, ransomware, scams, fraud or identity theft; (c) data loss; (d) third-party software or services; (e) problems outside our reasonable control, security steps you decline, or computers we could not manage.
11.2Our total responsibility to you under these terms is limited to what you have paid us in the six months before the problem happened, and neither of us is liable to the other for indirect or consequential losses. Sections 11.1 and 11.2 do not apply to our gross negligence or willful misconduct, or to liability the law does not allow to be limited.
12.Fair Use and Suspension
We may suspend service for non-payment, or for abuse such as threats or harassment of our staff or repeated requests meant to avoid paying for work outside the plan. We tell you the reason in writing.
13.Privacy
We use what we learn about you and your computers only to provide this service and to bill you. We share it only with the providers we use to do that, such as our payment processor and our remote management software provider, and as the law requires. We do not sell it. If we confirm a security problem involving your personal information that we hold, we will tell you without unreasonable delay.
14.Your Property and Data
Your files, accounts, passwords and hardware are yours. We never hold any of them hostage.
15.Cancellation and Termination
15.1You can cancel at any time online in your billing portal (linked in your welcome email), by phone at (573) 635-0201, or by email to support@modern1tech.com. A cancellation we receive before your next billing date stops that monthly charge and all later ones. We confirm every cancellation by email within one business day. If a charge goes through after you canceled, we refund it. There is no cancellation fee.
15.2Coverage runs through the end of the last paid month and ends there, whether you cancel or an automatic renewal fails after Stripe's retries. There are no partial refunds, except under section 15.4.
15.3Canceling does not cancel charges for work you already approved or support and on-site time already used. Support and on-site time not yet charged when you cancel is charged to your payment method on file on your final monthly charge or as a separate charge.
15.4We can end these terms with 30 days' written notice, or sooner if keeping you as a member would put us or other members at risk. If we end them before the end of a paid month, we refund the unused part of that month.
15.5When these terms end, we remove our management software from your computers.
16.General Terms
Missouri law applies. If we disagree, we talk first. If that does not work, either of us may take the matter to the courts of Cole County, Missouri, including small claims court. Neither of us may hand these terms to someone else without the other's OK, except that we may transfer them to a successor to our business. If any part is found unenforceable, the rest stays in effect. We may change these terms by emailing you at least 30 days before the change takes effect (price changes follow section 1.7); you may cancel before then and the change will not apply to you, and if you stay a member after that date the changed terms apply. "Written notice" in these terms includes email to the address on your membership. Your signup and these Terms of Service are the whole deal between us on the membership. Electronic signatures and electronic acceptance count as signatures.
17.Acceptance
17.1Online. Before you submit, our online signup form shows the automatic monthly charge, our standard shop rate for remote support, our on-site rate, our after-hours rate, and how to cancel. You accept by checking the required boxes agreeing to the automatic monthly charge, to support and on-site time billed as described in these Terms of Service, and to these Terms of Service, and then submitting the form. We review every signup. We accept when we approve your signup and your first payment is processed. When you accept, we record the date and time, your IP address and the Terms of Service version above, and keep that record with your membership. A copy of the terms you accepted comes with your welcome email and is always available at https://modern1tech.com/terms/home/.
17.2On paper. You accept by signing the signup sheet. The signup sheet carries the member signature and date. There is no signature from us. We accept when your first payment is processed. Your copy of the signed sheet, with these Terms of Service attached, is yours to keep.
